Just in time for Spring, LPG are delighted to deliver the latest instalment of #ATEMatters with our take on recent key decisions and judgments from the world of litigation and funding.  We start this month with a look at a Supreme Court decision setting out the legal principles applicable to negligence claims relating to damage to physical property. If your firm uses Litigation Funding then Topalsson v Rolls Royce is a definite read given the judgment regarding disclosure. DBAs still remain a bit of a grey area and next up is a decision centred on unenforceability of an agreement due to a breach of the rules. Finally this edition, we consider whether, if you terminate a CFA and claim damages for breach by the client, you are entitled to bill the client for costs and disbursements incurred? 2024 seems to have started with a rush and it’s already time for the February edition of #ATEMatters.  Our look this month at the latest key legal decisions and judgments starts with a very important case for anyone involved with litigation funding and or DBAs.  This latest PACCAR decision gives us some clarity on the validity of revising agreements and is a must read.   The case of Miller v Irwin Mitchell LLP is next up and the CoA judgment regarding Duty of Care followed by a look at the fallout from serving Proceedings by email.  Finally this month, a dive into CPR 3.9 and the Relief from Sanctions rules.   As always, do please get in touch if you have any comments regarding #ATEMatters or assistance with anything to do with ATE insurance or funding.  If you have any colleagues involved in Financial Mis-Selling or HDR claims, do please pass on our details as we would welcome the opportunity for a chat on what we can offer.   ATEMatters February 2024
