Cover is usually arranged by the acting solicitor with an individual stand-alone policy or through the operation of a fully delegated authority scheme arrangement. All delegated authority schemes are subject to application and approval from LPG. The key elements of the policy are as follows:

Cover

  • Other sides’ costs as required.
  • Own disbursements.
  • Cover for own Counsel’s fees (optional).
  • Part 36 cover.
  • Cover for interim cost orders.
  • No set up costs.
  • Competitive premiums.

Limit of Indemnity

  • Limit of indemnity for liability & causation expert report fees of
  • £10,000.
  • Standard limit of indemnity for own disbursements and other sides’ costs of £100,000.

Premiums

  • The premium is split into a “client” premium and “recoverable” premium.
  • The premium is deferred until the conclusion of the case.
  • The premium is only payable if the case has a successful outcome.
  • The premium is fixed in advance and depends on when the case concludes.
